Velocity Hub

These Terms and Conditions (“Terms”) apply to Velocity Hub, operated by Kylate, a subsidiary of Pupi.Co Pty Ltd (“we”, “us”, “our”). By purchasing, accessing, or using Velocity Hub or any included applications (including Designer), you agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not access or use Velocity Hub or any associated services.

1. Governing Law and Jurisdiction

1.1 These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.

1.2 You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.

2. About Velocity Hub

2.1 Velocity Hub is a subscription-based service providing access to a private community, educational resources, and proprietary AI-powered marketing applications.

2.2 Depending on your subscription tier, Velocity Hub may include:

  • Access to private community platforms (including Discord or similar)
  • Group calls, audits, or workshops
  • Access to proprietary AI applications operated by Kylate

2.3 Velocity Hub includes access to AI applications such as Designer. Designer is an AI-powered system that:

  • Scans and analyzes webpages you provide
  • Researches customers, competitors, and positioning
  • Generates demo webpages, layouts, copy, and highlights intended purely as inspiration

2.4 Designer does not directly modify or publish your live website. All implementation decisions and actions are your sole responsibility.

2.5 The availability, scope, and functionality of Velocity Hub and its applications may change over time and vary by subscription plan.

3. Pricing, Discounts, and Promotions

3.1 Subscription fees may vary based on:

  • Geographic location and currency
  • Promotional offers
  • Early access or limited-capacity discounts

3.2 You acknowledge that other users may pay different prices for similar or identical access.

3.3 Promotional pricing applies only while explicitly stated and may be removed at any time for new subscribers.

4. Subscription Start Date, Billing, and Auto-Renewal

4.1 Velocity Hub services, including access to Designer, commence from 15 January 2026, unless otherwise stated.

4.2 You will not be charged before 15 January 2026, regardless of any “trial” labels shown by third-party billing vendors.

4.3 Subscriptions are billed on a recurring basis and automatically renew by default until cancelled by you.

4.4 You are solely responsible for cancelling your subscription before renewal if you do not wish to continue.

4.5 Kylate will not issue refunds for failure to cancel, forgotten cancellations, or unused subscription periods under any circumstances.

4.6 You may cancel your subscription at any time via the Stripe, LaunchPass, or other billing portals provided.

4.7 Upon cancellation, access remains active until the end of the current billing period.

4.8 No partial refunds or credits are provided for unused time after cancellation.

5. Refund Policy and Post-Refund Enforcement

5.1 Except as expressly stated below, all fees are non-refundable.

5.2 You may request a full refund before February 2026 if you are not satisfied with Designer or Velocity Hub, provided that:

  • The request is made before the refund deadline; and
  • You have not materially updated your live website using outputs generated by Designer.

5.3 If a refund is granted and Kylate later determines that your live website is clearly and heavily inspired by Designer outputs, (where copy and layout are identical or very similar to our designer output compared to the saved HTML, text and screenshots of your website from before the designer page was generated, to the extent where a reasonable person would believe your website was inspired by the page generated by Designer), and we determine that your request for a refund prior to using the design to inspire your website is clearly deliberate and intentionally an act to benefit from the service for free in a malicious way, Kylate reserves the right to:

  • Contact you via email; and
  • Issue an invoice for unpaid services equal to the amount refunded.

5.4 If no agreement is reached following such an invoice, Kylate may pursue recovery of unpaid services through legal proceedings, with the same rights and standing as a human designer providing comparable services.

5.5 Changes to features, tools, release timelines, or call frequency do not entitle you to a refund.

6. Changes to Services and Roadmap

6.1 Velocity Hub is an evolving platform. Tools, features, and services may be added, modified, restricted, or discontinued at any time.

6.2 Group calls and community events may occur weekly, monthly, irregularly, or cease entirely.

6.3 If a core feature is permanently discontinued, Kylate will provide reasonable notice where practical.

6.4 The bundled nature of Velocity Hub does not guarantee the continued availability or standalone value of individual components.

7. Use of AI Applications and Restrictions

7.1 Access to Kylate applications is subject to fair use and technical limitations.

7.2 Unless otherwise stated, usage is limited to 12 generations or runs per month across all included applications.

7.3 Kylate reserves the right to impose additional limits, including but not limited to:

  • Usage caps
  • Account-level restrictions
  • One brand, business, or root domain per use or per account

7.4 AI-generated outputs are provided for inspiration and assistance only. You are solely responsible for:

  • Accuracy and verification
  • Legal, regulatory, and compliance review
  • Claims, representations, and commercial use

7.5 Kylate makes no guarantees regarding performance, conversions, revenue, or business outcomes.

8. Liability and Disclaimers

8.1 Velocity Hub and all Kylate applications are provided on an “as is” and “as available” basis.

8.2 Kylate is not liable for:

  • Errors, inaccuracies, or misinformation generated by AI
  • Business losses, lost profits, or reputational damage
  • Decisions made or actions taken based on outputs from the service

8.3 To the fullest extent permitted by law, Kylate disclaims all warranties, express or implied.

8.4 If a court of competent jurisdiction finds Kylate liable for any reason, Kylate’s total liability is strictly limited to the amount actually paid by you for the service, and no greater.

9. Service Availability and Force Majeure

9.1 Kylate is not responsible for interruptions, delays, or loss of service caused by:

  • Third-party vendors or infrastructure providers (including but not limited to AWS, Cloudflare, Discord, Stripe)
  • Vendors of our vendors
  • Internet outages, wars, terrorism, natural disasters, or acts of God

9.2 Such events do not entitle you to refunds, credits, or compensation.

10. Community and Discord Rules

10.1 You must not post pornographic, sexually explicit, illegal, or harmful content.

10.2 You must not use the community as an advertising or solicitation platform.

10.3 Mass unsolicited direct messaging is prohibited.

10.4 Discrimination or harassment based on race, sex, religion, sexuality, age, or physical attributes is strictly prohibited.

11. Termination

11.1 Kylate may suspend or terminate your access if you breach these Terms.

11.2 Termination may include loss of access to:

  • Velocity Hub
  • Community platforms
  • Designer and other Kylate applications

11.3 Termination for breach does not entitle you to a refund.

12. Chargebacks

12.1 Kylate maintains a zero-tolerance policy for chargebacks.

12.2 Initiating a chargeback without first contacting support will result in immediate and permanent termination.

12.3 This termination applies to all products and services operated by Kylate and Pupi.Co Pty Ltd.

13. Acceptance of Terms

13.1 By engaging with Velocity Hub—including signing up, paying, accessing services, or registering via LaunchPass—you confirm that:

  • You have read these Terms in full
  • You understand and agree to them without reservation
  • You are granted access to Velocity Hub and Kylate applications only while these Terms are met
